(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity, within the meaning of Section 13 of the German Civil Code (BGB).
§ 2 Conclusion of the Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
(2) By clicking the button to place an order with an obligation to pay, the customer submits a binding offer to purchase the goods contained in the shopping cart.
(3) After placing an order, the customer receives an automatic order confirmation by email. The purchase contract is concluded when we expressly accept the order through this confirmation or dispatch the goods.
(4) Before submitting an order, the customer can review and correct their entries using the functions provided.
§ 3 Prices and Payment Terms
(1) All prices displayed in the online shop are final prices and include any applicable statutory value-added tax (VAT).
(2) Any additional shipping costs are displayed separately during the checkout process.
(3) The available payment methods are shown to the customer during checkout. These include, in particular, Shopify Payments, PayPal and Klarna. The availability of individual payment methods may vary depending on the delivery country and the order.
(4) Payments are processed through the selected payment service provider. Unless otherwise agreed, the purchase price is due upon conclusion of the contract. For payment methods with different payment deadlines, the terms communicated to the customer during checkout apply.
§ 4 Delivery and Shipping
(1) Delivery is made to the shipping address provided by the customer during checkout.
(2) Available delivery countries, shipping costs and estimated delivery times are displayed on our website or during checkout.
(3) Orders are shipped primarily via DHL, Deutsche Post or FedEx.
(4) The risk of accidental loss of or damage to the goods generally passes to the customer only when the goods are handed over to the customer or a third party authorised by the customer to receive them. Statutory exceptions remain unaffected.
(5) If a shipment cannot be delivered due to an incorrect or incomplete shipping address or for other reasons attributable to the customer, we may claim reimbursement of the additional costs actually incurred. Statutory consumer rights remain unaffected.
(6) If an ordered item is exceptionally unavailable, we will inform the customer without undue delay. The customer's statutory rights remain unaffected.
§ 5 Right of Withdrawal
(1) Consumers generally have a statutory right of withdrawal for distance contracts.
(2) Details regarding the right of withdrawal, its consequences and the model withdrawal form are provided in our separate Withdrawal Policy.
(3) Withdrawal may also be exercised using our electronic withdrawal form:

§ 6 Retention of Title
The goods remain our property until the purchase price has been paid in full.
§ 7 Statutory Rights in the Event of Defects
The statutory rights relating to defective goods apply.
This also applies to second-hand goods and older individual items. Whether an item is defective is determined by the expressly agreed characteristics of the goods and the applicable statutory provisions.
§ 8 Liability
(1) We are liable without limitation for damage caused intentionally or by gross negligence, as well as for damage resulting from injury to life, body or health.
(2) In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to foreseeable damage typical for the contract. Essential contractual obligations are those whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment the customer may regularly rely.
(3) In all other cases, liability for damage caused by slight negligence is excluded to the extent permitted by law.
(4) Liability under the German Product Liability Act, for fraudulently concealed defects and under any guarantees assumed remains unaffected.
§ 9 Data Protection
Information about the processing of personal data can be found in our separate Privacy Policy at www.peter-fields.com.
§ 10 Applicable Law
(1) The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
(2) If the customer is habitually resident in another country, the mandatory consumer protection provisions of that country remain unaffected insofar as they cannot be excluded by a choice of law under the applicable legal provisions.
(3) The statutory rules on jurisdiction apply to any disputes.
§ 11 Contract Language and Contract Text
(1) The contract is concluded in the language offered during the checkout process.
(2) After placing an order, the customer receives a confirmation by email containing the essential order details. The contractual terms are made available to the customer in accordance with statutory requirements.
(3) The current General Terms and Conditions can be viewed and saved on our website.
